Cape Hope Building Supply – Terms and Conditions

By purchasing products or using services from Cape Hope Building Supply (“CHBS”, “we”, “our”, or “us”), you (“customer”, “you”) agree to the following terms and conditions. If you do not accept these terms, do not use our services or purchase products.

  1. General Information

  • CHBS operates under the trading name Cape Hope Building Supply.

  • Contact: chbsteam@gmail.com

  • All sales and services are governed by South African law.

  1. Customer Eligibility

  • Customers must be at least 18 years old.

  • By purchasing, you confirm you meet the age requirement and have the legal capacity to enter into these Terms.

  • We reserve the right to refuse service or cancel any order at our discretion, without providing reason. Full refunds will be issued in such cases.

  1. Products and Services

  • We sell building materials and provide installation services for certain products.

  • Not all products are eligible for installation. Check the product description for confirmation.

  • Product specifications, colours, and availability are subject to change without notice.

  1. Installation Services

  • Installation pricing may be included in “installed for you” products or quoted separately. Prices are indicative and may be adjusted for unforeseen site conditions.

  • Installation includes vinyl flooring and surface preparation. Skirtings, trims, and other finishing works are not included in the standard “installed for you” price and will be charged as an additional upcharge.

  • Customer responsibilities include:

    • Clearing the area completely.

    • Providing safe and reasonable access for delivery and installation.

    • Ensuring electricity and water connections are available where required.

    • Maintaining a safe environment (e.g., removing pets, hazards).

    • Treating CHBS staff with respect.

  • CHBS is not responsible for delays or additional costs caused by failure to meet these responsibilities.

  • Cancellation or rescheduling must be communicated via chbsteam@gmail.com or 072 481 9623.

  1. Payment Terms

  • Payment must be made in full via EFT or cash on site before delivery or installation begins.

  • No partial payments, deposits, or credit arrangements are accepted.

  • Payments are deemed cleared only when funds are reflected in our accounts.

  • CHBS may refuse service if payment is not received.

  1. Delivery and Returns

  • Please refer to our Delivery and Returns policy for details.

  • CHBS is not liable for delays due to circumstances beyond our control, including but not limited to weather, transport issues, or supplier delays.

  • Any collection, shipping, or installation fees are the customer’s responsibility unless otherwise agreed in writing.

  1. Warranty and Liability

  • Product warranties are provided exclusively by the manufacturer; CHBS is not responsible for product defects. We may assist in liaising with the manufacturer.

  • CHBS installation services are provided with reasonable skill and care. CHBS disclaims all liability for indirect, incidental, special, or consequential damages arising from installation or product use.

  • CHBS is not responsible for damage resulting from misuse, abuse, improper maintenance, natural wear and tear, or acts beyond our control.

  • Any claims must be submitted promptly. CHBS will not accept claims made after the installation has been completed for longer than a reasonable period.

  1. Limitation of Liability

  • To the fullest extent permitted by law, CHBS’s total liability for any claim arising out of or in connection with products or services shall not exceed the purchase price paid by the customer.

  • This limitation applies to all claims, including breach of contract, negligence, or any statutory claims.

  • Nothing in these Terms excludes liability that cannot be excluded under applicable law.

  1. Dispute Resolution

  • Parties agree to attempt good-faith negotiation in case of any dispute.

  • If negotiation fails, parties may pursue legal remedies in a competent South African court.

  • Jurisdiction shall be South African law, and venue shall be the courts closest to Cape Town.

  1. Changes to Terms and Conditions

  • CHBS reserves the right to update or modify these Terms at any time without prior notice.

  • Changes apply immediately upon posting on our website or communicating to customers via email.

  1. Customer Obligations and Conduct

  • Customers must provide accurate information and act in good faith.

  • Any abusive, threatening, or unlawful behaviour toward CHBS staff or representatives may result in termination of service without refund.

  • Customers must ensure the work area is safe and complies with applicable laws and safety standards.

  1. Acceptance

  • By purchasing or using our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions in full.

  • All Prices are Ex VAT, VAT will be charged at checkout and added to total.
